REACH deadline extension passed by UK Government

Three-year amendment passes through Parliament and applies to all UK and ‘Grandfathered’ REACH registrations.

The Department for Environment, Food and Rural Affairs (DEFRA) has extended the deadlines of the UK REACH transitional registration by three years.

The statutory instrument (or secondary legislation) extends the UK REACH transitional registration to 27 October 2026, 2028, and 2030 respectively dependent on tonnage and toxicity. It came into force on 19 July.

The extension also applies to all ‘Grandfathered’ registrations, a transitional provision that allows EU REACH registrations to be recognised under UK REACH. The provision allows companies to access the GB market potentially offering greater business continuity post-Brexit.

Speaking in the House of Lords in June to pass the amendment, Lord Benyon, Minister of State, Department for Environment, Food and Rural Affairs said: “I am confident that the provisions in these regulations mean that we will continue to ensure the highest levels of protection for human health and the environment, based on robust evidence and strong scientific analysis. At the same time, we are taking the necessary steps to provide industry with the legal certainty it needs to operate and to preserve the supply chains for the chemicals we depend on.”

Under UK REACH legislation, registrants must collect information on the properties and uses of the substances that are manufactured or imported above one tonne a year. Businesses are also required to assess the hazards of the substance and any potential risks presented by its uses.

    Does this mean that the sunset date for tetraethyl lead, used in light aircraft fuel, of 1 May 2025 will also apply in the UK? https://echa.europa.eu/authorisation-list/-/dislist/details/0b0236e1828a5e98

      No, that substance was added to EU Annex XIV after the end of the Brexit Implementation Phase so doesn’t appear on GB REACH Annex XIV (which still totals 54 substances). It can be still used in GB after 1st May 2025 whereas it can only be used in EU after that date with a corresponding authorisation covering that specific use from a supplier covered by the use authorisation. 🙂
