Unsafe scaffolding leads to fatal backwards fall

A 26-year-old man plunged to his death, after falling from height at a residential building site in Skegness.
Justin Gillman was carrying a band of 80 bricks when he fell backwards from the unguarded scaffolding.
The bricks then fell on top of Mr.Gillman after he hit the ground.
On the day of the incident (26 February 2010) Mr.Tute had instructed the bricklayer to erect the scaffolding without supervision.
The court heard that Mr.Gillman had no experience in building scaffolding and should not have been entrusted by Mr.Tute to undertake the task.
Chestnut Homes Ltd and their site manager, Peter Tute, was found guilty following an HSE investigation and sentenced at Lincoln Crown Court on 5 September1.
Richard Lockwood, the HSE inspector overseeing the investigation said: “There needs to be adequate control over scaffolding to ensure that their policies and procedures are implemented properly on their site.”
The subsequent HSE investigation found that the scaffolding posed a clear risk, despite Mr.Tute adjudging the structure was safe on the day of the incident.
Mr.Gillman, from Lincolnshire, died from his injuries at the scene.
His father, Alan Gillman said: “If anything positive can come from the case, and Justin’s death, it’s that I hope people will be prepared to say ‘no’ to their employer if they’re asked to something they’re not trained to do, or it wouldn’t be safe for them to do.”

Mr Tute has had a result if you ask me.
He knowingly instructed a young man to undertake a task for which is was not competent and as a significant contributory factor the young man is now dead as a consequence of his negligence.
The prosecution of the company indicates additional failure that contributed to this incident? it states above their policies and procedures need to be implemented? were they ignored? and by whom?
