Care home first to face corporate manslaughter charges

Three former care home bosses have appeared in court accused of manslaughter by gross negligence following the death of 86 year-old Ivy Atkin who died days after she was moved out of the Autumn Grange care home in Nottingham, in November 2012.

The care home company, Sherwood Rise Limited, also faces a charge of corporate manslaughter – the first case of its kind in England and Wales.

The company was accused of failing to provide Mrs Atkin with adequate food and drinks and check she was taking fluids.

A Care Quality Commission (CQC) inspection raised concerns about fire safety and cleanliness at the home, which closed in 2012.

Nottingham city council’s director of adult social services, Candida Brudenell, previously said about the home: “Last year, when the owners of Autumn Grange informed us at short notice and in breach of their contract with us that they intended to close the home, we acted swiftly to move all residents to alternative homes. Sadly one resident later died, and I extend my sympathy to her family.

“We have since been conducting a safeguarding investigation into issues at the home, in conjunction with the police and the Care Quality Commission and will continue to help the police with their investigation into the death of a former resident.”

Yousef Khan, 46, from Nelson Road, Nottingham, Mohammed Khan, 38, from Zulla Road, Nottingham and Naseen Kiani, 53, from Whirlow Grange Drive, Sheffield, have been bailed and will appear at Nottingham Crown Court in May.
